These Terms of Service ("Terms") govern your use of the services provided by Tidewater Digital ("we," "us," or "our"). By engaging our services or using our website, you agree to these Terms.
Tidewater Digital provides website design and development, AI chatbot solutions, photography, and related digital services. The specific scope, deliverables, and timeline for each project are agreed upon in writing before work begins.
Each project tier includes a set number of revision rounds as outlined in your proposal. Revisions beyond those included will be billed at our standard hourly rate. A revision is defined as changes to existing content — new sections or significant scope changes are treated as additional work.
Upon receipt of final payment, you own the final deliverables of your project. Tidewater Digital retains the right to display the work in our portfolio unless you request otherwise in writing. We retain ownership of any proprietary tools, templates, or frameworks used in building your project.
Clients are responsible for providing accurate content, credentials, and timely feedback. Delays caused by client inaction may result in revised timelines. You represent that any content you provide does not infringe on any third-party rights.
If we host your site, you agree to maintain a current payment method on file. Non-payment may result in service suspension. We are not liable for third-party hosting outages beyond our control.
To the fullest extent permitted by law, Tidewater Digital's total liability for any claim arising from our services shall not exceed the amount paid by you in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Either party may terminate a project with written notice. Fees for work completed to date are non-refundable. If you terminate, the deposit is forfeited. If we terminate without cause, we will refund any portion of the deposit for work not yet completed.
These Terms are governed by the laws of the Commonwealth of Virginia. Any disputes shall be resolved in the courts of Virginia Beach, Virginia.
We may update these Terms from time to time. Continued use of our services after any changes constitutes acceptance of the revised Terms.
